Whether tra​demarks, designs, patents, copyrights or know-how: intellectual property embodies a unique position, uniqueness and technological advantage and is thus an essential prerequisite for ​sustainable entrepreneurial success. The protection and defence of your intellectual property is of central importance in Kazakhstan. 

In Kazakhstan, ​​copyright law has been developing since the early 1990s and is now actively integrated into the legislation of the Customs Union member states with regard to unlawful use of foreign property, unlawful import ("grey import") and other aspects. Until recently, Kazakhstan's labour legislation focused on the protection of workers' rights and social welfare. With the drafting of a new Labour Code in 2016, the interests of both parties to the employment relationship are now to be equally weighted.

Intellectual property includes, above all, trademarks, copyrights, know-how, licences and patents. The protection of such rights requires in-depth knowledge in this area. Kazakhstan has ratified almost all international conventions and agreements in the field of copyright and intellectual property, so your copyrights are also protected in Kazakhstan.

The success of innovative ideas and products exerts a great attraction on product imitators and pirates. This also applies to Kazakhstan. The threat associated with this is omnipresent. Securing intellectual property and defending it consistently can prevent you from being outflanked by free riders, especially in highly competitive markets.

Protection against the unauthorised import of original products (so-called grey imports) also plays a not insignificant role. In Kazakhstan, trademark owners have the option of registering their trademarks in a customs register for intellectual property. The advantages of such registration are to control your distribution partners and to restrict or prohibit the unwanted import of protected goods by third parties.​
