Each company has its own legal personality. Disagreements among shareholders, as well as other internal company conflicts, can often not be settled by negotiation. In this case, the parties must turn to mediation services in the courts. In order to protect one's rights, it is important to have an advisor who knows Kazakh substantive and procedural law, along with measures of interim relief.

Arbitration clauses are often agreed in foreign trade contracts. Arbitration decisions are recognised in Kazakhstan and enforced according to general enforcement rules. Decisions of foreign courts are only recognised if conventions on the mutual recognition and enforcement of court decisions provide for this.​
